3.Definitions

For the purposes of these Terms, the following expressions have the meanings set out below.

3.1.Service Provider

The company or sole trader named in these Terms that operates the System.

3.2.System

A web-based condominium management application enabling, in particular: management of condominiums; resident registers; processing owner information; management of bank accounts; financial bookkeeping; petty cash records; utility accounting; management of common charges; document storage; electronic notifications; online voting; preparation of PDF and Excel statements; and other condominium management tasks.

3.3.User

Any natural or legal person authorised to use the System. This may include, in particular: a common representative; property manager; User, Demo Admin, Demo Admin 2 or Manager; accountant; owner; resident; tenant; audit committee member; or authorised representative.

3.4.Condominium

The condominium association or housing cooperative for whose management the System is used.

3.5.Super Administrator

The user with the highest access level in the System, authorised to manage system settings, user roles, condominium assignments and permissions for functions.

3.6.User Status

A subscription-based permission status allowing the user to use the functions authorised by the Super Administrator without a time limit. Within their organisation, the User may assign an unlimited number of Managers and determine the condominiums and authorised functions each can manage.

3.7.Demo Admin

A permission status granted for a 60-day trial period following registration. Within the permissions authorised by the Super Administrator, a Demo Admin has the same functional permissions as a User; the only difference is the 60-day time limit.

3.8.Demo Admin 2

A manager status assigned by a Demo Admin. A Demo Admin 2 may access only the condominiums and functions assigned by the superior Demo Admin; the expiry of their permissions follows that of the superior Demo Admin.

3.9.Manager

A manager assigned by a User. The Manager may use only those condominiums and functions assigned to them within the superior User's scope of permissions.

3.10.Expired Demo

After the 60-day Demo Admin period, previously recorded data remain available. New entries, editing and uploads are disabled. Authorised PDF and XLSX reports may still be downloaded. Full editing access requires active User status.

3.11.Resident

The owner, usufructuary, tenant or other authorised occupant of an apartment in the condominium.

3.12.Document

Any electronic file stored in the System, including, in particular: PDF files; Word documents; Excel spreadsheets; images; minutes; invitations; general meeting resolutions; reports; and other records.

3.13.Electronic Notification

An automated message sent by the System, in particular an email, system message or notification.

4.Scope of the Service

The Service Provider makes available online a comprehensive electronic record-keeping and management system for condominiums. The service may include, in particular, the following modules: Resident records apartments owners tenants ownership shares e-mail addresses telephone numbers Accounting bank accounting cash desk double-entry bookkeeping financial journal balances general ledger account numbers Common charges monthly assessments individual assessments payments amounts owed overpayments balances Utilities water meters hot water cold water heat consumption electricity gas consumption settlements Document management The System may enable the uploading, viewing, downloading, archiving and categorisation of documents. Online voting The System supports the conduct of electronic votes. Voting results may be stored electronically and retrieved. Reports The System may generate various financial and statistical reports, such as annual reports, cash reports, bank statements, resident balances, utility settlements, PDF reports and Excel exports.

5.Use of the Service

The System can be accessed from an internet-connected computer, tablet or mobile phone. The Service Provider does not guarantee full support for every browser or operating system, but endeavours to ensure proper operation in the latest versions of modern browsers. To use the System, the User must have an internet connection, a supported browser, a valid user account and appropriate permissions.

6.Registration

6.1.Registration Requirements

Use of the System requires registration. Registration may be initiated by a property manager, common representative, authorised representative of a condominium, apartment owner, tenant (if authorised) or other person authorised by the condominium. Information supplied during registration must be true and accurate. The Service Provider may delete or suspend accounts created with manifestly false or incomplete information.

6.2.Information Provided on Registration

The following information may be requested during registration in particular: name, email address, telephone number, apartment or unit identifier, owner or occupant status, username (if used) and password. Additional information may be required where justified by law or the operation of the service.

6.3.Email Address

The email address supplied must be genuine, working and accessible to the User. The User is responsible for keeping it functional. The Service Provider may send to that address, in particular: registration confirmations; password reset links; system notifications; general meeting invitations; document notifications; online voting notifications; payment notices; and security alerts.

6.4.Mandatory Email Verification

Email verification is required to log in to the System. All roles, including Super Administrator, User, Demo Admin, Demo Admin 2, Manager and Resident, may log in and use the System only after successfully following the verification link sent to their email address. Entering the correct password alone does not permit access until verification is complete. If the email address is later changed, the new address must be verified again. The User is responsible for maintaining access to the mailbox receiving verification and security notices.

7.User Account

7.1.Creating an Account

A user account is created after successful registration. Accounts are personal and may not be transferred to another person. Another person may access the System only through their own account with permissions assigned by the Super Administrator or an authorised User or Demo Admin.

7.2.Password

Users must choose a password that provides adequate security. The Service Provider recommends at least eight characters, including lowercase and uppercase letters, digits and a special character, and advises regular password changes.

7.3.Password Security

Users must keep their password confidential, must not disclose it to third parties or write it down in a publicly accessible location, and must change it immediately if unauthorised access is suspected.

7.4.Forgotten Password

If a password is forgotten, the System may offer an electronic method for creating a new password. A password reset link is valid only for a limited period.

8.Access Rights Management

The System uses role-based and condominium-based access management. The current status is displayed in the Role field of the user list. The Super Administrator may determine the menu items, functions and operations that each User and Demo Admin may access. A Demo Admin or User may delegate to a subordinate Manager only permissions that they themselves possess.

8.1.Super Administrator

The Super Administrator may, in particular: change system settings; manage users and roles; create and reassign condominiums and review access permissions; authorise or restrict menu and function permissions; and manage security, document and language settings.

8.2.User

A User may use the functions authorised by the Super Administrator without a time limit. A User may assign any number of Managers and specify for each subordinate the condominiums and functions they may manage.

8.3.Demo Admin

A Demo Admin may use for 60 days all functions authorised for them by the Super Administrator. Their functional permissions match those of a User but are limited in time. The Demo Admin may assign an unlimited number of Demo Admin 2 users and determine the condominiums and functions each may manage, within the permissions granted to the Demo Admin.

8.4.Demo Admin 2

A Demo Admin 2 may access the condominiums and permissions allocated by the superior Demo Admin. They cannot receive access to any condominium or function unavailable to the superior Demo Admin. They do not receive a separate 60-day trial period: their access expires at the same time as the superior Demo Admin's, regardless of when they were created or assigned.

8.5.Manager

A Manager may access the condominiums and functions assigned by the superior User. Any number of Managers may be assigned to one User.

8.6.Subordinate Managers and Condominium Assignment

On the Manager editing screen, a User or Demo Admin may select the persons assigned to them and specify which condominiums each Manager or Demo Admin 2 may manage. The System may visually distinguish assigned condominiums: green may indicate those originally entered by the user or an authorised person in their organisation, and red may indicate other condominiums already in the System. An authorised person may reassign a condominium to another User or Manager where justified.

8.7.Recording the Original Creator of a Condominium

For each condominium, the System may record the identity of the user who originally entered it and the time of initial entry. A subsequent reassignment, change of Manager or amendment of permissions does not overwrite the original creator or original entry time.

8.8.Prohibition on Duplicate Condominium Entries

The same condominium may not be entered again as a new condominium by another user. The System may check identifiers including name, address, tax number, land registry number or other unique data to determine whether the condominium already exists in the register. If so, saving may be refused with the message: ‘This condominium has already been registered. Please contact our customer service at www.thgo.hu@gmail.com!’ Access to an existing condominium must be resolved through permissions and reassignment rather than by creating a parallel record.

8.9.Expired Demo — proposed updated wording

When the Demo Admin's 60-day period ends, the Demo Admin and all associated Demo Admin 2 users change to Expired Demo status. From that time, they may not enter new data, modify existing data or upload files. They may continue to view their previously accessible condominium records and download authorised reports in PDF and XLSX formats. The expiry does not cause data loss: previously entered data remain in the System. Full editing access requires obtaining User status.

8.10.Resident

A Resident may access only the condominium and functions authorised for them. In particular, they may view: their own balance and payments; assessments of common charges; their utility statements; documents and general-meeting information available to them; online votes for which they are eligible; and their own profile.

8.11.Modification of Access Rights

The Super Administrator may modify or restrict any access rights. Users and Demo Administrators may modify the permissions and condominium assignments of their own subordinate users within the scope of their own access rights. In the event of unauthorised access or a security risk, the Service Provider may temporarily or permanently restrict certain permissions.

9.Use of the System

The User may use the System only for lawful purposes. In particular, the following are prohibited: unauthorised viewing of another user’s data, logging in on behalf of another user, circumventing the System’s security, automated data collection without authorisation, uploading malicious software, interfering with the operation of the System, causing excessive load, sending spam, uploading offensive or unlawful content.

10.Document Management

Documents that may be uploaded include, in particular: minutes of general meetings, resolutions, notices of meetings, financial reports, contracts, Terms and Conditions, Privacy Notice, other PDF, Word or Excel documents. Acceptance of the Terms and Conditions may be given through a recordable acceptance statement displayed during registration and contracting. The Service Provider informs contracted Users of material changes as required by applicable law; the precise method of acceptance and its recording must reflect how the System operates.

33.Severability

The Service Provider may impose file-size limits, scan files for viruses and automatically reject dangerous files. In Expired Demo status, file uploads and downloads are prohibited. This restriction does not entail deletion of previously recorded data and documents.

39.Storage Usage

Storage space may be provided to Users within the System. The Service Provider may set storage limits, archive data, move inactive data and monitor storage usage. The User may not use the System as a general file-sharing service.

40.Data Retention

The Service Provider retains data for the period required by law. The retention period may depend in particular on accounting legislation, tax laws, civil-law limitation periods, data protection rules and the duration of the contract between the User and the Service Provider. After the retention period, the Service Provider may delete or anonymise data unless the law provides otherwise. Expiry of the Demo period does not itself cause deletion of previously entered data. In Expired Demo status, the data remain stored, but editing, adding, uploading and downloading them is restricted as provided in these Terms and Conditions.

41.Archiving

The Service Provider may archive older data. Archiving serves performance, security, legal compliance and long-term retention. Restoring archived data may take longer due to technical limitations.

42.Terminated User Accounts

46.3.Classification of Errors

The Service Provider may classify reported errors by severity. Critical error: prevents essential operation of the System, such as inability to log in, data loss, failure of the accounting module or inaccessible database. High-priority error: the System remains usable, but an important function does not work properly. Normal-priority error: does not prevent normal use of the System. Low-priority error: a minor display or usability problem.

47.Reporting Errors

Users may report errors by email, through customer support or using a bug-report form. Reports should preferably include a precise description, the time of occurrence, a screenshot if available, the feature concerned and the browser and operating system used.

48.Planned Developments

The Service Provider may introduce new features, including new accounting modules, reports, export formats, a mobile application, artificial-intelligence features, electronic signature support, online bank connectivity, invoicing software integration and electronic invoice processing. Developments must not result in unjustified loss of existing data.

49.Subscription, Demo Period and User Status

49.1.60-day Demo Period

An eligible registrant may use the System with Demo Admin status for 60 days from registration. During the Demo period, the Demo Admin has the same functional rights as a User for the features authorised by the Super Administrator. The expiry date of Demo Admin 2 managers created by or assigned under the Demo Admin is the same as that of their supervising Demo Admin.

49.2.Expiry Notifications

The System may send an electronic warning to the Demo Admin before expiry of the Demo period, in particular five days in advance. On the expiry date, the Demo Admin and associated Demo Admin 2 Users may be notified electronically that they may no longer enter new data or upload or download data or files. The expiry restriction does not delete previously recorded data.

49.3.Activation of User Status and Acceptance of Terms

The Demo Admin may use a unique electronic link sent by the System to indicate the intention to switch to User status and accept the Terms and Conditions then in force. The System may log the date and time of acceptance and the version accepted. After successful acceptance, the technical permission may change to User status and the subscription period begins on the date of acceptance. The System may send electronic confirmation.

49.4.Subscription Fee and First Partial Month

The subscription fee may be calculated from the monthly per-resident rate set by the Service Provider. The number of Residents recorded in the System on the last day of the relevant month may be used for monthly settlement. For the first, partial month, only the pro-rated fee from activation through the last day of the month may be charged. The final resident count may be recorded on the last day, and the related invoice or payment notice may be issued or sent on the first day of the following month.

49.5.Non-payment of Fees

If a due subscription fee remains unpaid, the Service Provider may, with appropriate prior notice and within the limits of applicable law, restrict certain features or suspend access. Such restrictions do not themselves mean the deletion of data required to be retained under law or contract.

50.Changes to Fees

The Service Provider may change service fees. Users must be notified in advance. Changes do not apply retrospectively to periods already paid for.

51.Test Environment

The Service Provider may provide a separate test or development environment. Data stored there may be deleted or modified and do not constitute official records. Users must process only data whose use is lawful in the test environment.

52.Open-source Components

The System may use open-source software components subject to the licence terms of each component. Open-source licences do not affect the Service Provider’s copyright in its proprietary software elements.

53.Confidentiality

The Service Provider and the User must treat as confidential each other’s trade secrets and all information obtained while using the service. This obligation does not apply to publicly available information, data required to be disclosed by law or information disclosed in response to requests by authorities.

54.Inspection and Audit

The Service Provider may conduct security and technical inspections of System operations to maintain data security, optimise performance, detect unauthorised access and ensure legal compliance. During audits, it endeavours to minimise processing of Users’ personal data.

55.Electronic Evidence

Logs, event records and electronic timestamps recorded by the System may be used as evidence within the limits of applicable law, including logins, logouts, document uploads, changes in permissions, accounting transactions, online votes and delivery of system messages.

56.Assignment

Users may not transfer their rights or obligations under these Terms and Conditions without the Service Provider’s prior written consent. The Service Provider may assign rights and obligations associated with operating the service to its legal successor or contractual partner, provided that Users’ rights are not impaired.

57.Language and Interpretation

The System may be available in several languages. In the event of discrepancies, the Hungarian Terms and Conditions govern unless the Service Provider states otherwise. Translations are provided solely for Users’ information.

58.Final Provisions

These Terms and Conditions constitute the entire agreement between the Service Provider and the User regarding use of the System. If the User continues to use the System after the effective date, the Terms and Conditions are deemed accepted. They are published electronically and the Service Provider ensures their continuous availability within the System.

59.SimplePay Online Payment – Parties and Payment Recipient

Depending on contractual and technical settings, the THGO.hu condominium management application may offer SimplePay online payments. SimplePay Zrt. provides the payment service. BI88 Kft. operates the THGO.hu IT interface; use of that interface alone does not mean that BI88 Kft. is the creditor of all condominium claims shown in the System or the merchant for every payment. For THGO subscriptions or other services provided by BI88 Kft., BI88 Kft. is the creditor and, if so provided by contract, the SimplePay merchant. For common charges, utility charges or other condominium claims, the creditor and contracted SimplePay merchant depend on the actual legal relationship and SimplePay configuration of the relevant condominium. Before payment, THGO displays the condominium concerned, payment purpose, amount due and available merchant/beneficiary details. Obligations relating to different condominiums are processed separately. Claims belonging to different SimplePay merchants must be processed in separate transactions. SimplePay payment is available only after the relevant merchant account and technical integration are properly configured.

60.SimplePay Payment Process, Confirmation and Credit

When SimplePay payment is initiated, THGO sends the necessary transaction data to SimplePay and redirects the payer to the SimplePay payment interface. The payer completes payment and, where required, strong customer authentication there. Returning to THGO in the browser from the payment page does not itself constitute final financial confirmation of the condominium payment. THGO credits a payment as successful only when a verified server-to-server SimplePay confirmation (IPN) is received or an authenticated SimplePay query confirms the final successful status FINISHED. Cancelled (CANCEL), timed-out (TIMEOUT) or failed transactions are not credited as successful payments. THGO may retain the SimplePay transaction ID and data necessary for accounting reconciliation.

61.SimplePay Failed or Duplicate Payments, Refunds and Saved Cards

For failed, incorrectly valued or duplicate payments, Users may contact the merchant identified for the payment or THGO technical support, providing the transaction identifier. Questions about bank card authorisation or rejection may also require contacting the card-issuing bank. The legal basis for a refund is determined by the creditor, the applicable contract and the law. An approved refund may be made using the refund operation supported by SimplePay or another lawful method. This integration does not automatically enable card storage, OneClick payments or recurring automatic charges. These features may be used only after separate implementation, prior information and compliance with applicable SimplePay card registration conditions.

62.Packages, Subscriptions and Pro-rata Billing

THGO may offer Start, Pro and Max packages. The applicable prices, features, billing unit and subscription start date are set out in the ordering interface or price information provided when contracting. A fee or feature not specified in this document is not, by itself, a commitment. Where a subscription starts mid-month or the resident count changes, the System calculates charges using the pro-rata method explained at ordering. Restrictions on withdrawal of a package choice and conditions for later changes may be imposed only within applicable law and after clear advance notice. The fee charged and resident count used must be traceable.

63.Referral Programme and Discounts

The Service Provider may operate a referral programme. Discount eligibility and amount are determined by the terms published on the referral page and effective when joining. The calculation may be based on an eligible, verified resident count recognised under the programme rules. The referred person’s data may be used for contact only with appropriate information and a legal basis. Referrers may not consent to marketing messages on behalf of others. Discounts gained by unauthorised or misleading registration may be withdrawn in accordance with law and participation terms.

64.Data Access and Export on Termination

On termination of the contractual relationship, the parties arrange the release or transfer of condominium data, documents and financial records. Access must not be made unreasonably conditional on a new subscription where doing so would conflict with data controller or processor obligations. The form and formats of transfer, identification requirements, authorised recipient, costs and actual deadline are governed by the relevant contract and data processing agreement. Records subject to legal retention may continue to be held to the necessary extent; copies retained without justification must be deleted.

65.Review of Bank Imports and Automated Matching

Importing bank files, categorising financial entries and automatically matching them to residents provide technical assistance but do not replace substantive and accounting review by the manager. Managers must be able to deal with discrepancies and incorrect matches. The Service Provider investigates reported, demonstrable System errors. Liability is assessed considering the cause of the error, documented System operation, contribution of each party and mandatory law. Liability that cannot legally be excluded remains unaffected.
